Washington state banned Delta-8 THC through SB 5564 in 2021, which clarified that all THC isomers — including Delta-8 — are regulated as cannabis and may not be sold through the hemp market. Delta-8 THC products can only be sold through Washington's licensed cannabis retailers regulated by the Washington State Liquor and Cannabis Board. Unlicensed sales are subject to significant penalties.
