Is Delta-8 Legal in California?

California enacted AB 45 in 2021 which created a framework for hemp-derived cannabinoids including Delta-8 THC, but implementation has been phased and product standards are still being finalized. Delta-8 THC products may only be sold to individuals 21 and older and must meet state labeling, testing, and manufacturing standards. Sales through unlicensed channels remain subject to enforcement action pending full regulatory rollout.
